The Excise Department has issued new regulations holding bar owners accountable for crimes committed by individuals under the influence of alcohol. Under these rules, if a crime such as murder, assault, rape, or suicide occurs due to alcohol consumption, the bar owner who sold the alcohol will be considered indirectly responsible and face legal action, including licence cancellation.

In light of the recent Porsche accident in Pune, the Excise Department has started sending notices to bar owners holding FL-2, FLBR-2, and FL-3 licences. The notices clarify that under the Maharashtra Prohibition Act of 1949 and related rules, bar owners will be deemed indirectly responsible for crimes committed by intoxicated individuals. As a result, bar owners will be subject to legal action and treated as co-accused.

The notice also mandates that bar owners prevent the sale of alcohol to underage or unauthorized individuals. Any crime committed under the influence of alcohol will be considered to have occurred with the implicit consent of the bar owner, resulting in legal consequences and potential revocation of their licence. Bar owners are urged to take necessary precautions and remain vigilant to avoid such incidents.

Non-compliance with these regulations will lead to action under the Bombay Liquor Prohibition Act, 1949. Additionally, bar owners may face criminal proceedings as co-accused under other relevant laws. Violations observed during inspections will lead to permanent licence revocation, and any indirect involvement in crimes will be reported for further action. The notice underscores the importance of strict adherence to these regulations by bar owners.
