Pune News : Association of Ganga Satellite Co-operative Housing Societies Ltd. holds protest in Wanowrie

Over 300 residents of the society consisting of approximately 500 flats comprising of 2000 residents in 19 buildings today held a protest within the premises of Ganga Satellite society in Wanowrie putting up various demands from the builder. 

The residents protested holding placards demanding corpus one time maintenance, Amenities such as gym, swimming pool, chikdren’s play area not being handed over to the residents. 

The owners had purchased flats from 1996 (earliest known registration) and by end of 2005, more than 60% of the flats had been sold out i.e., registration formalities duly completed. While taking possession of the flats, each owner had paid a one-time maintenance fund to the developer (Goel Nitron Construction), and the total contribution from the 504 flats was about Rs 7.94 Crores. The flat owners have alleged that there are serious issues with regards to they have been cheated by the developer with Society Formation & Conveyance, one-time Maintenance, FSI & Construction, Side Margins, Open Spaces, Amenities and other aspects.

Upset over inaction after and repeated pleas, the 504 flat owners of Ganga Satellite Corporative Housing Societies Ltd. staged a protest against a local construction developer (Goel Nitron Construction) on February 11th, 2023.


Rajesh Mishra, Chairperson of The Association of Ganga Satellite Corporative Housing Societies Ltd. said “We’ve almost fought a long battle of over ten years to claim our 1-time Maintenance Corpus fund and one-time Maintenance fee from the builder but have been unsuccessful. After exhausting all options, we With no choice left and to make our case stronger we have filed a court case and hope to we can get a solution soon”.

Rajiv Malla, Chairperson Ganga Satellite A5 Cooperative Housing Society Ltd said “With our protest against the builder we aim to open the eyes of gullible people who get cheated easily by false promises. We also want to send out a message that treacherous cannot have an easy way out by remaining united and going about it systematically, the members / residents can get their due”. 

Swati Laulkar, customer service manager, Goel Ganga Group (Goel Nitron Construction) in a press release mentioned that the residents are unnecessarily targeting the company and creating pressure on them. The dispute started when the developer raised the demand of maintenance from the residents. The developer has till date spent Rs 16 crores. The developer has filed a case to recover maintenance amount from the society of which the suit is pending. A separate suit is pending for recovery of amounts and other reliefs, which is pending too. The developer fails to understand why a special marketing agency has been appointed to defame the developer ? By calling media and press conference it is direct interference with the process of administration of justice. The committee members are personally liable for legal action for causing defamation and contempt of Hon’ble Civil Court.”

The Construction developer began the individual building-wise, while society formation process completed in 2009 but had not conveyed the area to the respective societies till the end 2019. Importantly, the 1-time maintenance amount collected was never handed back to the societies when the societies were handed over from 2010 onwards. The common area conveyance has not been initiated at all and this land/plot continues to be in the name of the developer.

The lawyer representing the residents stated, “We are trying our best to ensure for justice for the residents and hope to be we are successful soon”.

Under Section 10 of Maharashtra Ownership of Flat Act,1963, it is mandatory for the builder to form the Society of Flat owners within 4 months and thereafter within 3 months to call the First General Meeting and handover the Corpus Fund / 1-time maintenance amount to the Provisional Committee formed along with all the records and documents.

As per rule no. 9 of Maharashtra ownership flats rules 1964, conveyance should be completed within 4 months from the date of registration of the society.

Residents have approached the police department, sought a meeting with CP Pune, approached PMC by filing RTI etc. but feel that they have not got the desired cooperation from the agencies.
