Pune: The Juvenile Justice Board (JJB) on Tuesday, in compliance with the Bombay High Court’s earlier order, directed the release of the 17-year-old involved in the May 19 Porsche Taycan car crash in Kalyaninagar. The teen was released from the observation home and placed in the custody of his paternal aunt.

The teenager’s lawyer informed a news agency that, due to the absence of the High Court’s order copy reaching the JJB by evening, they filed a written statement (pursis) requesting the minor’s release. The High Court had deemed his detention illegal. The principal magistrate of the JJB reviewed the statement and ordered the teen’s release. He will now reside with his paternal aunt in Pune.

The lawyer further stated that the board did not impose any conditions on the teen’s release, as his detention since May 22 was ruled illegal.

A senior officer from the city police, speaking anonymously, mentioned, “We will now await the JJB’s decision on our application filed on May 22, which seeks to try the teenager as an adult on the grounds that the incident constitutes a heinous crime. This plea is pending final disposal.”

The JJB is authorized under sections 14 and 15 of the Juvenile Justice (Care and Protection) Act to determine if a child in conflict with the law (CCL) can be tried as an adult. This decision follows a preliminary inquiry assessing the severity of the offence. The inquiry’s scope is limited to evaluating the juvenile’s capacity to commit and comprehend the consequences of their actions.
